These terms govern your use of oohula, an app made by Die Digitalen GmbH, Switzerland. By downloading or using oohula, you agree to them.
Your licence to use the app
oohula is licensed, not sold, to you under Apple's Licensed Application End User License Agreement (Standard EULA), together with these terms. Where the two differ on a point we describe here, these terms apply.
What oohula is — and isn't
oohula is a language-coaching companion. It helps you practise through conversation and gives feedback to guide your learning. It is not certified instruction, a formal qualification, or a professional translation or interpretation service, and it shouldn't be relied on as such.
Coaching, feedback, and dictionary entries are generated by AI, and AI makes mistakes: an explanation, a translation, or a pronunciation verdict can occasionally be wrong, and you may pick up a word or concept incorrectly as a result. We accept no responsibility for inaccuracies in AI-generated content or for anything learned from it. If you need to learn a language accurately — for an exam, for work, or for any high-stakes situation — complement oohula with lessons from a qualified teacher.
Your account and acceptable use
You agree to use oohula lawfully and not to:
- misuse, overload, probe, or attempt to circumvent the service or its usage limits;
- reverse-engineer, scrape, or resell the service or its content;
- use it to generate unlawful, harmful, or abusive content.
We may suspend access that threatens the integrity or availability of the service.
Subscriptions and billing
oohula offers optional subscriptions that include more coaching. Purchases are made and managed through Apple. Payment is charged to your Apple Account, and subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can view, change, or cancel a subscription anytime in Settings → your name → Subscriptions on your device. Refunds are handled by Apple under their policies.
Fair use
Your subscription gives you full access to oohula — lessons, conversations and pronunciation checks. We do not sell you a quota of them, and we do not charge you anything beyond your subscription price. However much you practise in a normal day — however much you practise in a very heavy day — we will not stop you.
Coaching runs on two speeds. For a generous amount of practice each day you are coached by our strongest model. After that, coaching continues on a faster, lighter model for the rest of the day, and resets the next day. The reason is simply cost: the strongest model is expensive to run, and this is how we keep full access available to everyone at one price instead of metering you or cutting you off. You can see which one is coaching you at any time in the app, under Settings.
There is one outer limit, and it exists to catch software rather than people. At a very high daily volume we slow the pace of replies for the rest of that day, so your practice continues and simply runs slower. At a far higher volume again — several times more than a person could produce in a day of continuous practice — replies pause until the next day. We set that limit where automated use is the only realistic way to reach it, and we would rather tell you it exists than pretend it does not.
Practising a lot never counts as misuse, and none of the above affects your account — the pace and the daily limit apply to replies, and everything resets the next day. Suspending or ending an account is separate, and we do that only for conduct, never for volume: automated or scripted use, running the app through software rather than as a person, sharing one account between several people, or reselling access. Where we can, we will warn you first and give you a chance to put it right.
We may change these limits, for example if model costs or capacity change. If a change materially reduces what your subscription gives you, we will tell you at least 30 days beforehand by email or in the app, and you may cancel and receive a refund for the unused part of your billing period. Changes we make to prevent abuse, to keep the service secure, or to comply with the law may take effect sooner.
Some earlier subscription plans, no longer on sale, included a set amount of daily practice rather than full access. If you are on one of those, the allowance you subscribed to still applies.
Third-party services
Coaching is generated by Claude, an AI model made by Anthropic, and spoken by ElevenLabs. Using oohula means what you write and say is sent to them so the coach can reply. Our Privacy & Data Policy lists exactly what is sent, and to whom.
The service is offered as-is and depends in part on the availability and performance of these providers.
Disclaimers and liability
To the fullest extent permitted by law, oohula is provided "as is" without warranties of any kind, and Die Digitalen GmbH is not liable for indirect or consequential damages arising from your use of the app. Nothing in these terms limits liability that cannot be limited under applicable law.
Changes
We may update these terms; we'll revise the date above and, for significant changes, note them in the app. Continued use after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of Switzerland, without regard to conflict-of-laws rules, and subject to any mandatory consumer-protection rights in your country of residence.
